What is a Prenuptial Agreement?
A prenuptial agreement, or “pre-nup,” is a binding contract detailing the way property and assets will be divided in the event of a divorce. These agreements exist to simplify the divorce process by clearly spelling out the terms of property division, and they are a useful tool for some couples.
Do You Need a Prenuptial Agreement?
In general, you may wish to consider a prenuptial agreement if you are entering a marriage with substantial financial assets that exceed those of your spouse. For example, if you anticipate receiving a large inheritance, own shares in a company, or have significant investments, you may wish to protect those from the possibility of divorce. Without a prenuptial agreement, you risk losing up to half of your assets in the divorce.
Note that there are some issues that cannot be addressed in a prenuptial agreement, including child support, custody, alimony, and personal (rather than financial) matters. We can discuss your individual situation with you, answer your questions, and create an agreement that will fit your needs. Contact us today to schedule a legal consultation.
